1. Introduction

Welcome to Elasoft. These Terms of Conditions ("Terms") govern your access to and use of the Elasoft Campus Operating System, including all related modules (ÖBYS, EBYS, PBYS, etc.), websites, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Definitions

• "Company" refers to Elasoft Yazılım ve Bilişim Teknolojileri Limited Şirketi.
• "Customer" refers to the University or Institution that has subscribed to the Service.
• "User" refers to any individual (student, faculty, staff) authorized by the Customer to access the Service.
• "Data" refers to all information, documents, and records uploaded to the Service by the Customer or Users.

3. License & Access

Subject to your compliance with these Terms and payment of applicable fees, Elasoft grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your internal educational and administrative purposes.

This license is valid for the duration of the subscription period as defined in the Service Agreement signed between Elasoft and the Customer.

4. User Obligations

You agree not to:

• Reverse engineer, decompile, or disassemble any aspect of the Service.
• Use the Service to store or transmit malicious code, viruses, or harmful data.
• Attempt to gain unauthorized access to the Service or related systems.
• Use the Service in violation of applicable laws, including KVKK and GDPR.

5. Intellectual Property

The Service, including its architecture, code, algorithms, and design, is the exclusive property of Elasoft. All rights not expressly granted to you are reserved by Elasoft.

The Customer retains all ownership rights to the Data uploaded to the Service. Elasoft claims no ownership over Customer Data.

6. Data Protection & Privacy

Elasoft is committed to protecting your data. We process personal data in accordance with the Law on the Protection of Personal Data No. 6698 (KVKK) and, where applicable, the General Data Protection Regulation (GDPR).

7. Limitation of Liability

To the maximum extent permitted by law, Elasoft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Elasoft's total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount paid by the Customer to Elasoft in the 12 months preceding the event giving rise to the claim.

8. Termination

Elasoft may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. Provisions of the Terms which by their nature should survive termination shall survive.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts and enforcement offices in Trabzon, Türkiye.
